How to apply for a Street Trading Consent

but please see the guidance below if you are not familiar with the
application process or would simply like to know more.
- Applicants must be aged 17 or over.
- Applicants must complete an application form.
- Two copies of a plan must be supplied showing the position in
which it is proposed to trade, unless the applicant is already an
established trader in premises situated within the designated
consent street.
- Two passport type photographs of the applicant must be
supplied.
Before a Street Trading Consent is considered by its Licensing
Committee, the Council will seek the views of both the Director of
Community Safety and Engineering and the Head of Environmental
Services on the application. Their written observations will be
taken into consideration by the Committee when determining the
application.
The sufficiency of other trading outlets will also be
taken into consideration in respect of:0
- The presence of similar outlets already existing in the
immediate locality of the proposed street trading site.
- The general needs of a locality should no comparable outlets be
in existence.
The proposed street trading activity should be carried out from
a trading unit that complies with the relevant legislation.
Observations from the Council on the compliance with the
requirements of Food Safety and Hygiene, Health and Safety and
Environmental Protection legislation shall also be taken into
consideration.
The location of the proposed street trading activity
should not:
- Present a substantial risk to the public in terms of road
safety, obstruction and fire hazard.
- Present a risk to public good order in the locality in which it
is situated.
- Present a substantial risk of nuisance from noise, smells or
fumes to businesses in the vicinity of the proposed site.
When granting a Street Trading Consent, the Council may attach
such conditions to it as they consider reasonably necessary to
prevent obstruction of the street or danger to persons using it,
etc. Failure to comply could result in prosecution and/or the
Street Trading Consent being revoked. A consent may be granted for
any period not exceeding 12 months, and can be revoked at any
time.
In normal circumstances, an application will take approximately
8 weeks to process. The Council will write to you informing you of
its decision. You must not trade as a Street Trader until you have
obtained the Consent from the Council.
Where the Council refuses an application, the applicant will be
informed in writing of the reasons for not granting the
application.
The legislation does not allow any legal appeals against the
decision of the Council in relation to the issue of a Street
Trading Consent. A person aggrieved by the decision of the Council
may seek a Judicial Review of the decision should they feel it is
necessary.
Where payment of the fee has been made with an application, the
fee will be returned to the applicant in the case of an application
not being granted.
In the event of the Consent-holder changing his/her vehicle or
mode of selling, details must be supplied to the Council who will
inspect the new vehicle.
