Fly-tipping law and enforcement

What is Fly-tipping? "the illegal deposit of any waste onto land that does not have a licence to accept it"

Fly-tipping is a serious criminal offence which can be punishable by unlimited fines, imprisonment and the restriction of use of a vehicle used to commit the offence.

Fly-tipping is often associated with dumping waste from vehicles. In this case the person controlling the use of the vehicle can also be prosecuted, which means that it is possible for a prosecution to occur when only the vehicle, not the driver, is identifiable.

How we enforce the law

We have a team of enforcement officers who investigate Fly-tipping on public land and public highways, including grass verges and footpaths.  We are unable to deal with fly-tipping on private land.  Our officers give advice and can issue fines if anybody is found to be committing an offence.

We investigate and prosecute offenders using intelligence and information that we receive from concerned residents.  In some cases we use surveillance cameras to catch people Fly-tipping large quantities of waste.
