Licensing Act 2003 - Alcohol, Entertainment and Late Night
Refreshment
The Licensing Act 2003 will replace existing licensing
legislation controlling, the sale of alcohol, public entertainment,
late night refreshment houses, theatres, registered clubs, and
cinemas.
The purpose of the Act is to promote four licensing
objectives:
- Prevention of crime and disorder
- Prevention of public nuisance
- Prevention of harm to children
- Public Safety
This is an important piece of legislation bringing together the
responsibility for liquor licensing, registration of private
members' clubs and social clubs (which were administered by the
Magistrates Courts), public entertainment, and night cafes under
one licensing authority, namely your local Council.
The new Act covers the following activities which will need to be
licensed by the Council:
The supply of alcohol.
- The provision of regulated entertainment.
- The supply of alcohol to club members and their guests.
- The provision of late night refreshment.
- This means that anyone who is concerned with the following will
be affected.
- Pubs and nightclubs.
- Indoor sporting events.
- Off-licences.
- Restaurants that serve alcohol.
- Businesses offering hot food after 11.00 p.m. i.e. takeaways,
fish and chip shops, service stations etc.
- Hotels, guest houses and other places selling alcohol.
- Private members' clubs and social clubs.
- Theatres and amateur dramatic groups.
- Cinemas.
- Organisers of occasional entertainment events.

Under these new arrangements, the Council has had to
publish a Statement of Licensing Policy, which will be used to
determine all applications made under the terms of the Act. The
policy must be reviewed every three years.
