Gambling Act 2005

The Gambling Act 2005 consolidates and repeals the Betting, Gaming and Lotteries Act 1863, The Gaming Act 1968 and the Lotteries and Amusements Act 1976.

The Act has introduced a new regulator – the Gambling Commission, which will regulate gambling in the public interest. The Commission will be responsible for issuing:- Operator Licences and Personal Licences

Under the Act, Bromsgrove District Council will be responsible for issuing:

 

Premises Licences

The type of establishments requiring Premises Licences are:

  •          Bingo Halls
  •          Casinos
  •          Betting Offices
  •          Adult Gaming Centres
  •          Family Entertainment Centres

In addition to issuing Premises Licences, the Licensing Authority will issue permits. These are required when premises provide a gambling facility where, both the stakes and prizes are very low or gambling is not the main function of the premises. Examples of such permits are:

  •          Family Entertainment Centre Gaming Machine Permits
  •          Club Gaming Permits
  •          Club Machine Permits
  •          Licensed Premises Gaming Machine Permits
  •          Prize Gaming Permits

 

The final area of responsibility for the Licensing Authority relates to the provision of:

  •        Occasional Use Notices (betting on a ‘track’ on 8 days or less in a calendar year)
  •        Temporary Use Notices (where there is no Premises Licence, but where a gambling  operator wishes to use the premises temporarily for providing gambling facilities)

The Act contains three licensing objectives:-

  •      To prevent gambling from being a source of crime and disorder
  •      To ensure that gambling is conducted in a fair and open way
  •      To protect children and other vulnerable persons from being harmed or exploited by gambling.
