Street Trading

In accordance with Schedule 4 to the Local Government (Miscellaneous Provisions) Act 1982, Bromsgrove District Council has adopted the Street Trading Consent Scheme which covers the selling or exposing or offering for sale of any article in a designated street. This means that you need to obtain a Street Trading Consent from the Council before you can trade in a 'consent street'. 

In order to regulate this type of activity, to ensure equitability for all traders and to improve service provision, the Council’s Licensing Committee agreed to designate the whole of the Bromsgrove District as a consent street, with the exception of Bromsgrove High Street and its immediate environs.

The Council has designated the whole of the District as a 'consent street' with the exception of the following locations, which will be classed as 'prohibited streets':

High Street

All parts

Worcester Road

All parts

Hanover Street

All parts.

St. John Street

All parts.

Chapel Street

All parts

Mill Lane

All parts

Church Street

All parts

Market Street

All parts.

Station Street

All parts.

 

The term 'street' is defined by statute and includes any road, footway or any other area to which the public have access without payment.

Trading in Council-owned car parks

It is not possible to apply to trade in any of the Council-owned car parks; for example, the Recreation Road car park adjacent to Asda; as this is in contravention of the Car Park Order (the legal document which governs the use of the car parks). The exact wording is:

"Except with the consent in writing of the Council, no person shall use a vehicle while it is in a parking place in connection with the sale of any article to persons in or near the parking place or in connection with the selling or offering for hire of his skill or services."

Exemptions from the need to obtain consent

Some types of trade are exempt from the need to obtain consent to trade in a street. These include the following:

  • Pedlars trading under the authority of a Pedlars' Certificate.
  • Selling things as part off the business off a roundsman e.g. a
    milkman (but not ice cream vans).
  • News vendors trading in the sale of newspapers and periodicals only, provided that they are not sold from a stall or similar structure or, if they are, that it stands on the carriageway of a street and its dimensions do not exceed 1 metre in length, 2 metres in height and does not occupy a ground area of more than 0.25 square metres.
  • Trade at fairs and markets which hold a right to trade.
  • Trade at petrol filling stations
  • Trade carried out in the street adjoining a shop provided that it is part of the business of that shop.
