Social Prescribing Privacy Notice

Why do we collect your data?

Our Social Prescribing service is about promoting a wide range of social, economic and healthy lifestyle interventions and support.

The Social Prescribing Service is delivered by Bromsgrove District Council on behalf of Bromsgrove Primary Care Network.  To provide the Social Prescribing service, Bromsgrove District Council collect your personal information for the purpose of delivering support on behalf of the Bromsgrove Primary Care Network.  The information collected from you will vary depending on the nature of the service.

This service is suitable for adults over the age of 18.

What is the legal basis for collecting your data?

The lawful basis on which we collect and use your personal data under the UK GDPR is:

  • Article 6(1)(e): Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority that is set out in law. 

We may also collect and use special categories of personal data, for example about your health or disabilities, specifically in order for us to provide you with the Social Prescribing service.

The lawful basis on which we collect and use this special category data is:

  • Article 9(2)(b): Employment, social security and social protection (if authorised by law)
  • Article 9(2)(h): Processing is necessary for the provision of health or social care.
  • Article 9(2)(j): Processing is necessary for statistical purposes (which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject).

The law we rely on is:

  • Care Act 2014
  • Health & Social Care Act 2012

Criminal record is also classed as special category data and is processed in accordance with Article 10, processing of personal data relating to criminal convictions and offences.

If you chose not to provide us with some of this information, we may not be able to assist you fully.

What data do we collect?

Patients can access the Social Prescribing Service via a health care professional, who will refer them, for example, the GP, and some of this information will be provided to us directly from them or by a patient self-referring or by another agency making a referral on behalf of the patient with consent.

Patients referred will be contacted by the Social Prescribing Service Link Worker.

The Council holds personal information about you which may include:

  • Name
  • Date of birth
  • Contact details
  • NHS number
  • Reason for referral
  • Existing referrals
  • Family circumstances / Lifestyle / social circumstances
  • Financial information
  • Health information including disabilities
  • Details of current support networks
  • Offences
  • Contact Details of Emergency Contacts

We will process your data to:

  • Deal with your enquiries;
  • Administer your record;
  • Create a care plan for review;
  • Enable referrals or requests for services;
  • Gather support from other organisations by signposting to other resources and agencies such as Learning Online, Citizens Advice Bureau, Community Groups & Activities; or
  • Refer back to your GP;
  • Monitor effectiveness of those activities.

We will also record statistical information about the service provided to you for commissioning purposes and national collections.

There may be occasions when we will ask you for consent to use your data, for example to help us inform the public about our work. If this is the case, we will explain to you exactly what your data will be used for. Examples of this are:

  • Sharing your personal story.
  • Taking part in a satisfaction survey.
  • Taking part in ongoing data collection and evaluation.

You can withdraw your consent at any time by contacting your Social Prescribing Link Worker.

Social Prescribing Emergency Contact

Bromsgrove District Council collect personal information about you to fulfil the role of Emergency Contact on behalf of the patient within the Social Prescribing service.    The legal basis for this processing is consent; if you do not wish to be nominated as a contact, please let us know.  This will not affect your rights.  More of which can be found on our website.

The data collected is:

  • Name
  • Contact details
  • Relationship to the patient

Where you agree to be contacted, the data will be kept until it is either overwritten or until you no longer agree to be an emergency contact. 

Will we share your data with others?

For the provision of the service on behalf of the Bromsgrove Primary Care Network, data will be stored securely on a Council database whilst support is being provided and will be transferred securely to the appropriate GP surgery at closure and stored on an Electronic Patient Record system, EMIS, which belongs to the Bromsgrove Primary Care Network.   Privacy notices for Bromsgrove Primary Care Network can be found here.

Whilst this information is stored securely on the Council database, this will be accessible by Social Prescribing staff.

Where you have appointed a relative or friend as an emergency contact, it may be necessary to share data in case of emergency, however this will always be proportionate to the need.

How long will we keep your data for?

Your data will be kept in line with the retention periods specified in the Records Management Code of Practice for Health and Social Care 2016.
